These Terms of Use ("Terms") govern your access to and use of the Texas NTS platform, including the website at www.texasnts.com and all associated subdomains and applications (the "Service"), operated by TexasNTS, LLC, a Texas limited liability company ("TexasNTS," "we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Description of Service
Texas NTS is a subscription-based data intelligence platform that monitors all 254 Texas county clerk websites, extracts Notices of Trustee's Sale (NTS) filings using multi-agent AI extraction, and delivers structured, confidence-scored foreclosure notice data to subscribers. The Service includes the Notice Explorer, saved search configurations, watchlist management, email alert digests, data export tools (CSV and JSON), and an AI-powered research assistant.
The Service is designed for real estate professionals, investors, legal professionals, title companies, and other business users seeking to monitor Texas foreclosure activity. It is not a consumer product.
Public Records Disclaimer
All Notice of Trustee's Sale data surfaced through the Service consists of public records filed with Texas county clerks pursuant to Texas Property Code §51.002. TexasNTS does not create, originate, or modify these filings. We extract, structure, and index publicly available information to make it more accessible.
While we apply multi-agent AI extraction, confidence scoring, and human review to maximize accuracy, we make no warranty that any record is complete, current, or error-free. Extracted data may differ from the original source document due to OCR limitations, formatting variations, or filing irregularities at the county level.
You are solely responsible for verifying any record against the original county clerk filing before making any financial, legal, or investment decision. Always consult the source document and, where appropriate, qualified legal counsel.
No Legal or Financial Advice
THE SERVICE DOES NOT PROVIDE LEGAL, FINANCIAL, INVESTMENT, OR REAL ESTATE ADVICE. Nothing on the platform constitutes professional advice of any kind. The AI assistant and AI brief features are informational tools only and should not be relied upon as professional guidance. TexasNTS is not a law firm, financial advisor, or licensed real estate professional.
You acknowledge that you will independently verify all information before acting on it and that you bear full responsibility for any decisions made based on data obtained through the Service.
Accounts and Eligibility
Account Creation
To access the Service, you must create an account through the platform. Account creation and authentication are managed by Auth0. You agree to provide accurate information (first name, last name, and email address) and to keep that information current.
Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent that you are of legal age and have the authority to enter into these Terms, either individually or on behalf of a business entity.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@texasnts.com if you suspect unauthorized access to your account. We are not liable for any loss arising from unauthorized access to your account.
Single-User Accounts
Each subscription is for a single named user. Account credentials may not be shared with other individuals or entities unless you have subscribed to an Enterprise plan with multiple user seats. We reserve the right to suspend accounts we reasonably believe are being used by multiple individuals.
Subscriptions and Billing
Plans
The Service is offered under the following self-serve monthly subscription tiers, plus a contact-sales Enterprise tier:
- Starter — Access to up to 5 counties, $39/month
- Professional — Access to up to 30 counties, CSV and JSON bulk export, $79/month
- Statewide — All 254 counties, priority support, earliest feature access, $129/month
- Enterprise — Custom pricing, direct API access, custom webhooks, multiple user seats
Plan details, including county limits and feature inclusions, are as described on the pricing page at www.texasnts.com/pricing at the time of your subscription. We reserve the right to modify plan features and pricing with reasonable notice.
Billing
Subscriptions are billed monthly in advance. All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis. You are responsible for maintaining a valid payment method on file.
Billing Statement Disclosure
Payment processing for the Service is currently handled through Stripe accounts maintained by Palpabl, LLC, an affiliate of TexasNTS, LLC under common ownership. As a result, charges for your subscription may appear on your credit card or bank statement as "Palpabl" rather than "TexasNTS." Invoices and receipts issued by Stripe will identify the merchant as Palpabl, LLC; however, individual line items on those invoices will identify the specific Texas NTS subscription tier purchased (for example, "TexasNTS Starter," "TexasNTS Professional," or "TexasNTS Statewide").
If you have questions about a charge appearing on your statement as Palpabl, or need documentation for your own records confirming the charge relates to a Texas NTS subscription, please contact us at support@texasnts.com and we will provide written confirmation.
County Restrictions
Counties may only be removed from your selected county list once per sale cycle (defined as the period between the filing deadline and the first Tuesday of each month). You may add counties at any time up to your plan limit.
Cancellation
You may cancel your subscription at any time from within your account or by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months, except as required by applicable law. After cancellation, you retain access to the Service through the end of your paid period.
Failed Payments
If a payment fails, we will attempt to notify you via email. If payment is not resolved within a reasonable grace period, we may suspend or terminate your access to the Service until the balance is resolved.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Scrape, crawl, or use automated means to extract data from the platform beyond the export functionality provided
- Resell, sublicense, or redistribute any data obtained through the Service to third parties without our written consent
- Use the Service to build a competing product or service
- Attempt to gain unauthorized access to any portion of the Service or its underlying systems
- Interfere with or disrupt the operation of the Service or its infrastructure
- Use the Service in any way that violates applicable federal, Texas, or local law
- Misrepresent data from the Service as original research or primary source filings
We reserve the right to suspend or terminate accounts that violate these prohibitions, without prior notice, at our sole discretion.
Data Exports and Permitted Use of Data
Data exported from the Service (CSV or JSON) may be used for your own internal business purposes, including analysis, research, and investment evaluation. You may not redistribute, sell, or publish extracted data as a standalone data product or feed without our written consent. Linking to the platform or citing Texas NTS as your data source in internal reports or analyses is permitted.
All data made available through the Service is derived from public records, but our collection, structuring, confidence scoring, and presentation constitute proprietary value-added work product belonging to TexasNTS, LLC.
Intellectual Property
The Service, including its design, software, AI models, confidence scoring methodology, platform architecture, and all associated content created by TexasNTS, is owned by TexasNTS, LLC and protected by applicable copyright, trade secret, and intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Service for the purposes described herein. No other rights are granted.
The underlying Notice of Trustee's Sale filings are public records and are not owned by TexasNTS.
Disclaimers and Limitations of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR NOTICE WILL BE CAPTURED OR ACCURATELY EXTRACTED.
Data Accuracy
While we invest substantially in accuracy through multi-agent extraction and human review, we do not guarantee that any individual record is accurate, complete, or timely. Confidence scores reflect our internal quality assessment only and are not a guarantee of correctness. You assume full responsibility for verifying data against original source filings.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TEXASNTS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSSES RELATED TO MISSED FORECLOSURE OPPORTUNITIES, INACCURATE RECORDS, MISSED ALERTS, OR SERVICE DOWNTIME.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO TEXASNTS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless TexasNTS, LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) any decision you make based on data obtained through the Service; or (d) your violation of any applicable law.
Third-Party Services
The Service integrates with third-party providers including Auth0 (authentication) and Stripe (payment processing). Your use of these services is subject to their respective terms and privacy policies. TexasNTS is not responsible for the practices, availability, or actions of these third-party providers. Links to third-party sites or services do not constitute endorsement.
Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes to the Service that would materially affect your subscription.
We may update these Terms from time to time. We will post the updated Terms at www.texasnts.com/terms and update the Effective Date above. Material changes will be communicated by email or via notice within the platform. Continued use of the Service following the effective date of updated Terms constitutes acceptance. If you do not agree to updated Terms, you must cancel your subscription before they take effect.
Termination
You may stop using the Service and cancel your subscription at any time as described in Section 5.5.
We may suspend or terminate your access to the Service, with or without notice, for: (a) material violation of these Terms; (b) non-payment; (c) conduct we reasonably believe exposes us or other users to harm or liability; or (d) as required by law. Upon termination, your license to use the Service immediately terminates. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Lubbock County, Texas, and you consent to personal jurisdiction in those courts.
We both agree to attempt informal resolution of any dispute before filing a formal claim. To initiate informal resolution, contact us at support@texasnts.com with a written description of the dispute.
Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TexasNTS with respect to the Service and supersede all prior agreements or representations.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
No Agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and TexasNTS.
